Police Brutality: COEUR D'ALENE -- More allegations of misconduct have surfaced against the Coeur d'Alene Police Department. An image from a video of deloyd Scott in an altercation with Coeur d'Alene Police officers, in which he was allegedly tasered seven times. In a federal lawsuit filed in February again the Coeur d'Alene Police Department, deloyd Scott claims he was tortured by being tasered seven times, as he passed by a traffic stop on his bicycle in May of 2008. However, officers say they were doing their job. Most of the incident was caught on tape by Cory Temple, who says he was recording speeders in his neighborhood with his video camera. The video shows things escalating quickly between Scott and officers. Scott appears on police dash cam video riding his bike past the scene. "When this officer's eyes saw me, he just honed in on me like a missile," An officer asked for Scott's identification, but by law, Scott does not have to show it, so he refused. "I responded, 'Am I under investigation for a crime?' He snapped back, 'Yes you are.' I said, 'I need assistance of counsel,'" says Scott. Eventually, Scott was wrestled to the ground, ending up holding one of the officer's flashlights. Scott was then tasered. Temple continued taping the incident. At that point, video becomes poor; however, the audio picks up Scott being tasered again after hitting an officer with the flashlight. Soon, officers approached Temple, asking for the tape.     They don’t need to be serving random warrants out on the street, when serving a warrant they use known addresses etc., I understand what you are saying but just because it “would” make it easier for them to bust people with warrants doesn’t meant this is how the law is set up, the lawmakers saw other issues as being more important than their ability to serve an outstanding warrant. Like your right to not be unlawfully detained.

    From what I understand verbal identification is sufficient.

    A police officer can ask for your id at any time. If they couldn’t they would almost never be able to arrest people with warrants because they wouldn’t be able to identify them. And you don’t have to be under arrest for them to detain you they can detain you temporarily while they wait for a witness to id you or something like that.

    Explain “Reasonable Suspicion” to me. I know it as “Probable Cause” and the problem we are facing these days is that police use ANYTHING to constitute probable cause (RS), in order to detain people. There are clear lines as to what constitutes probable cause and it is obvious these cops saw this guy and gambled that they could mess with him, maybe even find contraband, based on his appearance. This is called “Profiling”, am I wrong? Profiling, detaining, confiscating videocams…tsk tsk tsk

    So we’re supposed to look the other way when these things happen because other cops don’t do this? Explain your logic please.

    They take abuse every day because they chose to do this job, if they cannot handle it they are not made of “the right stuff”.

    The cops with humility and professionalism need to police the ones who act this way and make your ridiculous “99%” 100%.

    EVERY COP needs to be a good cop.

    I am amazed at how many people WANT there to be martial law and WANT to have no rights, so they sit here and make comments in support of police who violate the rights of citizens. It’s like shitting in your own nest, it shows the stupidity of this nation at large.

    People are so brainwashed from watching “COPS” and these law enforcement reality shows as well as plain ignorance of their own rights as citizens of the US.

    Yes, so can a shoe, a pencil, an Ipod, a purse, a rolled up notebook can be a weapon. Other than using any object in the world to strike somebody with, most people are not turning their cameras into secret flame throwers and projectile canons. The logic is ridiculous.

    Its fine & dandy to sit here and talk shit but why exactly dont you care about your fellow countrymen and how theyre treated daily from police misconduct?

    Unless there is probable cause, you do not have to produce anything to a police officer. That would be the same as the SS demanding your papers.

    It is called UNLAWFUL DETENTION, unless youre under arrest, youre not under their authority. I think this is what the man meant by “you have no jurisdiction over me”

    There needs to be probable cause for arrest. It is not logical to arrest for not doing what you cant ask them to do in the first place, this is why there needs to be probable cause.

    This is not Nazi Germany (yet?). We do not have to be accosted by Police just because we look like someone they can detain for no reason.. If a cop asks me on the street minding my own business, “Where iz za paperz,?” I will readily tell him I don’t have any.

I as an American do appreciate your view towards police overstepping their authority, but MC’s around the country these days aren’t really that “hard”. In fact, many of them do alot of great things for the community… Maybe your club is out of the norm. (oh no!!). I don’t respect “outlaw” MC’s. Why? Because they strive to break laws..

    You are partialy correct.. the only time someone has to show id (depends on state laws) is when they’re operating a motor vehicle. In any other situations, no id is needed to be handed over via IV amendment.

    EdMajin: By law if someone is not operating a car, they are not obligated to show id. IV amend says “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue but upon probable cause…” This is not Nazi Germany where an officer can accost someone on the street and asks for “za paperz” cause the guy looks scary. a right not practiced is a right lost.

    actually yes.. they are PUBLIC SERVANTS. If someone ask’s a police officer for a Supervisor, they’re suppose to get the supervisor of ether the shift and/or scene.’
    If someone of the public/press ask’s for a badge number, that officer is to ether provide the number via speaking it out loud, showing the badge, or providing some sort of credentials (business card). A piece of metal over they’re cold heart is not always good enough.
